10 things you didn't know about claiming compensation

1) You can still claim, even if the accident was partly your fault

If you were involved in an accident and it is found that it was partly caused due to your own negligence, you could still be entitled to compensation. We will assess your position and be able to tell you if you have a claim within minutes.

2) It doesn’t have to take years to get the compensation you deserve

Many people assume that the claims process is long-winded, time-consuming and involves a lot of unnecessary hassle. We will aim to resolve your case in months not years and take the work off your hands so that you can focus on your recovery.

3) You can claim compensation on behalf of a minor

A parent or guardian can act on behalf of a minor, subject to certain conditions, as a ‘litigation friend’ and make all the legal decisions on behalf of the victim. If the claim is successful, the damages will usually be put into a special investment account which the child can then access when they turn 18. However, a judge may decide to release the funds at the time of settlement if there are compelling reasons to do so i.e. treatment needs or special education requirements

4) Compensation claims are not just for car accident victims

If your health has suffered as a result of a third party’s negligence, the chances are you will be entitled to compensation. At Lance Mason, we also assist the victims of slip and trips, accidents at work, work-related illnesses and diseases and medical negligence.

5) You may not get the best deal if you settle directly with insurers

While cutting out the middle-man may seem like a good way getting things sorted quickly, many who have settled directly with insurers often come out with much less compensation than if they had had a qualified solicitor representing them. You need to make sure you seek out experts that understand how much your injuries are worth and will fight your corner to ensure that you receive the maximum compensation.

6) What you think are law firms may actually be claims management companies

Not every advert you see is for an actual law firm. Many of these are claims management companies that will deal with your enquiry and then pass your case onto a solicitor. Lance Mason is an active law firm and with experts in all areas of personal injury. We will be able to decipher whether you have a case or not in a matter of minutes and start progressing your claim today.

7) Chances are, you probably won’t have to go to court

Many people are put off the idea of making a claim for fear of the courtroom. It might be scary for those who have never been to court however it is unusual for cases to progress to this stage. We will do our best to settle on an amount that is right for you in order to avoid the stress of going to court- but in the event you do have to attend, we will make sure you are fully comfortable and confident with the process.

8) You can still claim compensation if you were hit by an uninsured vehicle

There is a general perception that if you are hit by an uninsured vehicle, you cannot claim compensation. It is easy to understand why so many people think this- who will you recover the funds from? Lance Mason can help you seek compensation from the Motor Insurers Bureau (MIB) who have funds set aside for road accident victims.

9) You can only make a claim within 3 years of sustaining an injury

If you were injured in an accident that wasn’t your fault, you have three years to claim compensation. Complex cases often take slightly longer to reach a settlement so it is important to get your claim started as soon as possible. There are some exceptions to this rule, for example, if you sustained a work-related illness or disease that only appeared years after exposure.

10) Making a claim doesn’t have to cost you anything

Despite the stereotypes, most initial consultations with solicitors are free of charge and making an enquiry won’t cost you a penny. Most people think that if they try to claim compensation and lose, their pockets will be considerably lighter. This is false- Lance Mason operates on a no-win, no-fee basis so in the event your claim is unsuccessful, you won’t be left with a big bill.

Every case is different and is subject to circumstantial conditions. To find out if you have a case, call Lance Mason free of charge today on 08000 84 2000.
