Breach of contract

What is a breach of contract?

When an offer is put forward by one party and this is accepted by another party in writing, this is known in law as a binding contract. A breach of contract occurs when this agreement is not adhered to by one or more parties. Contracts can range from simple agreements between businesses and individuals to more complex franchise, distribution or commercial agreements.

There are two incidences that can occur as a result of a breach of contract:

  • One or more parties may choose to pursue a court order in order to enforce the terms laid out in the contract
  • One or more parties may choose to pursue compensation for any damages incurred as a result of the breach
